Terms and Conditions
By booking with Shuck Yeah, operated by 3 Fish Co Pty Ltd and Dawson’s Oyster Supplies, you (the Client) agree to the terms and conditions outlined below. These terms are designed to ensure clarity and a smooth working relationship between all parties. Please take a moment to read them carefully.
1. Definitions
“Services”: Refers to our catering and event services, including, but not limited to, the provision of food and staff.
“The Equipment”: Includes all goods provided by Shuck Yeah for your event, such as the Oyster Cart, the Full Oyster Bar, and any associated accessories or consumables.
“The Client”: Refers to you - the individual or authorised representative engaging our services.
“The Site”: The agreed location where the event will take place and/or where the equipment will be used.
“We”, “Us”, and “Our”: Refers to Shuck Yeah, including our employees, representatives, and contractors.
2. Payment Terms
A 50% deposit is required at the time of booking to secure your event date.
The remaining balance must be paid no later than 7 days prior to the event date.
A minimum spend of $860.00 + GST applies to all catered events within the Newcastle, Hunter and Lake Macquarie region. A minimum spend of $2,200 + GST applies to all catered events outside of our general service area.
3. Cancellations
All cancellations must be made in writing to hannah@shuckyeah.com.au.
More than 30 days’ notice: Full refund of your deposit.
Between 30 and 14 days’ notice: 50% of the deposit will be retained.
Between 13 and 7 days’ notice: 100% of the deposit will be retained.
6 days or less: The full invoice amount is non-refundable.
In the rare and unexpected event that you need to cancel last minute, we may be able to reschedule your booking to a new date (subject to availability). We assess these requests on a case-by-case basis and will do our best to accommodate.
4. Equipment Responsibility
Our Shuck Yeah team will take great care of all the equipment we bring along, but if things get a bit too lively and there’s damage due to guest misuse or negligence, the Client is responsible for covering those costs. We’ll send an invoice for any repairs or replacements, and we kindly ask that it’s taken care of within 7 days.
5. Event Details, Food & Staffing
The Client must confirm all package options and add-ons at the time of booking.
Any changes to your package must be submitted in writing no later than 7 days before the event.
If the party goes longer than planned (we love when that happens!), additional fees will apply at a rate of $25 per 30 minutes, per staff member. This will be invoiced post-event.
6. Food Allergies
We’re all about serving up the freshest molluscs and shellfish, but it’s up to you, the Client, to make sure your guests know what’s on the menu.
Shuck Yeah will not be held liable for any allergic reactions or incidents resulting from mollusc and/or shellfish consumption.
7. Feedback
Got something on your mind during the event? Don’t hesitate to flag down one of our friendly team members. We’re here to help and will work to resolve any hiccups right away. Your feedback is super important to us, so feel free to reach out with any comments or questions after the event, too.
8. Media & Promotion
We love capturing the magic of each event, and we might share a few snaps, videos, or
kind words on our social media or website. If you’d rather keep things private, just shoot an email to hannah@shuckyeah.com.au before your event, and we’ll make sure to respect your wishes.
9. Disclaimer of Warranties & Limitation of Liability
Shuck Yeah provides its services on an “as is” and “as available” basis without warranties of any kind. While we aim for excellence, we cannot guarantee flawless service or outcomes.
We are not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of our services.
10. Indemnification
By engaging our services, you agree to indemnify, defend, and hold harmless 3 Fish Co Pty Ltd trading as Shuck Yeah, along with its directors, employees, and affiliates, from any claims, losses, damages, or legal costs resulting from your use of our services. Basically, if anything goes sideways on your end, you’ve got our back.
11. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of Australia.
